REPUBLICA BOLIVARIANA DE VENEZUELA TRIBUNAL QUINTO DE PRIMERA INSTANCIA EN LO PENAL EN FUNCIONES DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ESTADO TACHIRA San Cristóbal, 05 de abril de 2005 194° Y 146° Visto el escrito presentado por la Fiscal Cuarta del Ministerio Público ABG. ANDREINA TO-RRES, en el cual solicita al Tribunal el CESE DE LA MEDIDA CAUTELAR otorgada al ciu-dadano PULIDO CANTOR DANIEL ALFONSO en fecha 29 de diciembre de 1999, por el delito de ROBO AGRAVADO DE VEHÍCULO, en virtud de haberse decretado el ARCHIVO FISCAL de conformidad con lo establecido en el articulo 315 del Código Orgánico Procesal Penal en fecha 15 de marzo del 2005. De lo antes expuestos, este TRIBUNAL DE PRIMERA INSTANCIA EN LO PENAL EN FUNCIONES DE CONTROL NUMERO CINCO DEL CIRCUITO JUDICIAL PENAL DEL ESTADO TACHIRA, ADMINISTRANDO JUSTICIA, EN NOMBRE DE LA REPUBLICA Y POR AUTORIDAD DE LA LEY, DECIDE: ÚNICO: Se decreta el cese de la medida cautelar otorgada al ciudadano PULIDO CANTOR DANIEL ALFONSO en fecha 29 de diciembre de 1999, por el delito de ROBO AGRAVADO DE VEHÍCULO, por haberse decretado el archivo fiscal DE CONFORMIDAD CON EL ARTI-CULO 315 DEL Código Orgánico Procesal Penal en fecha 15 de marzo del 2005.
